1. Acceptance

By using the mertenlandclearing.com website or requesting services from Merten Land Clearing & Excavation LLC, you agree to these terms of service. If you do not agree, please do not use the site or submit a service request.

2. Services

Merten Land Clearing & Excavation LLC provides land clearing, excavation, grading, forestry mulching, demolition, drainage, and related site work services in Ohio, Northern Kentucky, and Southeast Indiana. Service availability and scheduling are subject to capacity and geographic scope.

3. Estimates and quotes

Estimates provided through our website, chat widget, or by phone are preliminary and based on information provided by the customer. Final pricing is confirmed after on-site evaluation. Estimates are not binding contracts and may be revised based on actual site conditions, scope changes, or information not disclosed at the time of estimation.

4. Communications and SMS consent

By providing your phone number through our website chat widget, you authorize Merten Land Clearing & Excavation LLC to contact you by phone or text message regarding your inquiry, quote, or project. Message and data rates may apply. Message frequency varies. Consent to receive text messages is not a condition of purchase.

5. Scheduling and property access

Scheduling is confirmed after mutual agreement on scope and pricing. You are responsible for ensuring reasonable equipment access to the work area at the scheduled time. If access is not available, a rescheduling fee may apply. Rescheduling requests should be made at least 24 hours in advance when possible.

6. Payment

Payment terms are established at the time of quote acceptance. We accept cash, check, and major credit cards. Invoices are due upon project completion unless otherwise agreed in writing. Unpaid balances may be subject to collection action and associated costs.

7. Utilities and buried structures

It is the property owner's responsibility to have all underground utilities, pipes, cables, and buried structures located and marked before work begins. Merten Land Clearing & Excavation LLC is not liable for damage to utilities, structures, or property features that were not disclosed or marked prior to the start of work.

8. Limitation of liability

To the extent permitted by law, Merten Land Clearing & Excavation LLC's liability for any claim arising from services or website use is limited to the amount paid for the services at issue. We are not liable for indirect, incidental, or consequential damages.

9. Website use

This website is provided for informational purposes only. We make no warranty that the site will be error-free or continuously available. Content is subject to change without notice. Use of this website does not create a contractor-client relationship.

10. Governing law

These terms are governed by the laws of the State of Ohio. Any disputes arising under these terms shall be resolved in the courts of Hamilton County, Ohio.
